Present:- Sh. Nishchay Kapoor, Ld. Counsel for the plaintiff.
Heard. File perused.
Non-starter report of pre-institution mediation, statement of
truth and list of documents are already on record.
Issue summons for settlement of issues to the defendant
through all permissible modes i.e. RC/Speed Post/
Courier/E-mail/Whatsapp and FAX etc. on filing of PF and soft copy of
complete paper book of the suit in PDF format. For service through
electronic mode, plaintiff to file affidavit with respect to the correctness
of the address and contact details.
Steps for service and process fee be filed within one week.
Directions:-
1. Service of defendant;
2. Written statement along with statement of truth, affidavit
of admission and denial of documents, list of documents as well
as the documents etc. be filed by the defendant within the
statutory period as contemplated under Commercial Courts Act
from the date of service with advance copy be given to the
opposite party;
3. Replication along with affidavit of admission and denial of

documents be filed by the plaintiff within the period of 45 days of
receipt of copy of the written statement, if any with advance copy
be given to the opposite party.
