On 06.06.2022, on behalf of defendant, reply
(written statement) with application for condonation of delay and
affidavit of admission and denial of documents was filed. Copy
was received.
Today application for substitution of AR of plaintiff
bank has been filed by Ld. Counsel for plaintiff. Copy given.
Above said affidavit for admission and denial of
documents of plaintiff filed by defendant is not compliant of Rule
4 Order XI CPC applicable to commercial dispute of specified
value for want of requisite information and in absence thereof the
above said written statement in the form of reply, cannot be
considered to be compliant of order dated 08.02.2022.
Ld. Counsel for defendant seeks adjournment for
taking appropriate steps.
Adjournment granted subject to costs of Rs. 2,000/-
payable by defendant to plaintiff/Counsel within two days against
receipt.
Replies to above said applications be filed after
supplying the copy to the opposite party/Counsel in two weeks.
Fixed 24.08.2022 for arguments on application of
defendant for condonation of delay in filing written statement
