It is submitted on behalf of the plaintiff that the matter
be returned as the address of the plaintiff falls in jurisdiction of
Dwarka Courts. Heard.
On perusal of plaint it is observed that the
plaintiffs are resident of West Sagarpur. As per as per the notification
no. F.6/33/89Judl./Vol.I/814824 dated 17.10.2012 West Sagarpur falls
under Revenue Division Dwarka, South West District. Therefore, this
Court does not have the territorial jurisdiction over the matter.
Ld. Counsel for the plaintiff concedes that this Court
does not has territorial has territorial jurisdiction to try the present suit.
Accordingly, subject to retention of certified copies on
record, the plaint alongwith the entire set of the documents be returned
to the plaintiff for presentation before the appropriate forum.
File be consigned to records.
