Ld. Counsel for the respondent submits vakalatnama
along with Board Resolution. Ld. Counsel for the respondent
submits that he has no objection if appeal No.235/2025 be
transferred from the court of Sh. Dhirendra Rana, Ld. ASJ-07,
PHC, NDD, where connected appeal is pending.
The present application has been filed for seeking
transfer of appeal bearing No.235/2025 on the ground that
judgment in case U/s.138 of Negotiable Instruments Act, 1881
was passed by the court of Ms. Anjali Singh, Ld. JMFC (NI
Act)-03, PHC, NDD on 26.10.2023. Out of the same judgment,
two separate appeals have been filed, one by the complainant and
one by the accused.
The appeal No.235/2025 has been filed by the
applicant, whereas appeal No.249/2025, which is pending in the
court of Ms. Shefali Barnala Tandon, Ld. ASJ-06, PHC, NDD
has been filed by the accused.
Both these appeals have emanated from the same
judgment, therefore, it would be expedient if both the appeals are
decided by the same court. Accordingly, appeal No.235/2025 is
withdrawn from the court of Sh. Dhirendra Rana, Ld. ASJ-07,
PHC, NDD and is assigned to the court of Ms. Shefali Barnala
Tandon, Ld. ASJ-06, PHC, NDD, where appeal No.249/2025 is
already pending, for dealing the same in accordance with law.

Parties are directed to appear before the Court of
Ms. Shefali Barnala Tandon, Ld. ASJ-06, PHC, NDD on
16.02.2026.
Ahlmad concerned is directed to send the file before
the transferee court forthwith.
