This court is working with only one Stenographer.
Present: Sh. Dilip Kumar (through VC), Ld counsel for
plaintiff along with plaintiff.
The present suit for partition is filed by the plaintiff
against 18 defendants. As per the order sheet dated 06.04.2022,
summons of the suit were served upon defendant nos. 2 to 11 and
18. Further, as per order sheet dated 23.01.2023, summons were
also served upon defendant no. 1. Further, as per order dated
13.12.2023, summons were served upon defendant nos. 15 and
16, while defendant no.14 was deleted from array of parties.
As such, till today defendant nos. 12 and 13 have not
yet been served. Plaintiff is directed to take appropriate steps
with regard to service of summons upon defendant nos. 12 & 13.
Furthermore, the present suit was filed by the
plaintiff under Order XXXIII CPC claiming himself to be
indigent person. Thereafter, on 04.10.2025, an application was
filed by the plaintiff seeking to deposit the court fees and same
was allowed. As such, since the court fees is already filed by the
plaintiff, the present suit shall no more continue for plaintiff
being indigent.
Now to come up on 17.02.2026.
