Affidavit as per provision of Order XI Rule 6(3)
CPC filed. However, steps not taken for service of defendant.
Heard. Subject to payment of cost of Rs.2500/-
imposed upon plaintiff to be deposited with Advocate’s Welfare
fund, one more opportunity is granted to plaintiff to effect the
service of defendant. Issue fresh summons of the suit to the
defendant at all available addresses on filing of PF/RC/Speed
post by plaintiff for next date. Summons be also issued on email
ID of defendant on taking appropriate steps. Steps be taken
within one week’s time from the date of this order.
Summons shall indicate that written statement has to
be filed by the defendant within 30 days (extendable upto 120
days with the leave of the court and that too subject to
appropriate terms) from the date of service of the process as per
the Proviso of Sub Rule 1 of Order 5 Rule 1 CPC as applicable to
the Commercial Courts Act.
