This is an application u/s 482 BNSS filed on behalf of
applicant/accused Akash Bhardwaj for grant of anticipatory bail.

Ld. Substitute Public Prosecutor has submitted that as per
reply, despite issuance of two notices under Section 35(3) BNSS, the
applicant has not joined the investigation.
IO has submitted that two co-accused persons, who are in
custody i.e. Kasim and Chand Babu have disclosed that they had sold
their account to the present applicant for commission and there are
some
whatsapp chats between the present applicant and the co-accused
Chand Babu which have been recovered from the mobile of co-accused
Chand Babu.

IO, at this stage, has submitted that applicant may be
directed to join the investigation on 28.01.2026 and the applicant
should handover his account details and other electronic devices i.e.
mobile phone(s) and laptop(s) during investigation.
Ld. Counsel for the applicant has submitted that the
applicant would joint the investigation on 28.01.2026 and would
handover all the electronic devices including mobile phone(s) and
laptop(s) and would also submit the account details of the applicant to
the IO.
In view of the submissions, it is directed that the applicant
would join the investigation with the IO on 28.01.2026 and would
cooperate in the investigation and would handover his account details
as well as electronic devices including mobile phone(s) and laptop(s) to
the IO during investigation. He would continue to join investigation as
and when directed by the IO and shall cooperate in the investigation.
Applicant - Akash Bhardwaj be not arrested till next date
of hearing.
Put up for further consideration on the application on
30.01.2026.
