Present: Ms. Radha Singh, Ld counsel for the plaintiffs.
Sh. Noor Alam, Ld counsel for the defendant along with the defendant
in person.
Considered the last orders. Though Ld counsel for the defendant states
that the WS has already been filed, however, as per the report of the Ahlmad, no
WS has been filed. Even no advance copy has been supplied till today. Vide last
order dated 31.08.2022, defendant was granted an opportunity to file the WS within
two weeks. Though Ld counsel for the defendant reiterates that WS was filed on
17.09.2022, however, as discussed above, no such WS is available on record.
Things would have been different had the copy been supplied to the opposite side.
Else the submissions are on merit list.
Nonetheless, putting the entire controversy at rest, defendant is granted
an opportunity to file the WS within two days from today with advance copy to the
plaintiff. Previous cost of Rs. 5000/- has been paid to the plaintiff.
For not supplying the advance copy of WS, defendant is again
burdened with the cost of Rs. 3000/- to be paid to the plaintiff.
Plaintiff may file the replication if any to the WS.
Relist the matter for filing of WS, replication, filing of affidavit of
admission and denial of documents/framing of issues on 22.10.2022.
