Present: Ld. Counsel Ms. Radha Singh for the plaintiffs.
Ld. Counsel Sh. Asad Alvi for the defendant.
Ld. Counsel for the defendant has appeared upon service of notice
upon the defendant of application seeking early hearing, filed by the plaintiff.
Considered the application. Though the application is opposed by the Ld.
Counsel for the defendant, however, considering the age of the plaintiff and
nature of suit, request of preponement stands allowed.
Perused the records. Defendant had put his appearance on
05.10.2021, however, till date no WS has been filed by the defendant. Statutory
period for filing the WS has long expired. Nonetheless Ld. Counsel for the
plaintiff submits that she has no objection if one last opportunity is given to the
defendant to file the WS. In view of the submissions made and in the interest of
justice, defendant is at liberty to file the WS within two weeks from today
subject to cost of Rs. 5000/-, to be paid to the plaintiff towards the delay already
caused in filing the WS. Advance copy of the WS be supplied to the plaintiff.
Relist the matter now on 11.10.2022 for filing of WS, replication
and admission/denial. Earlier date stands cancelled.
