This is an application filed under Section 438 CrPC.
On 06.01.2023, statement of the complainant Sh. Swarn Kumar
regarding settlement was recorded in Bail Application No. 16/2023 of
co-accused Mehboob Khan. On that very date, combined statements of 06 co-
complainants / victims were also recorded in Bail Application No. 16/2023 of
co-accused Mehboob Khan.
Today, combined statements of another 16 co-complainants /
victims has been recorded in Bail Application No. 16/2023 of co-accused
Mehboob Khan.
It is submitted on behalf of applicant / accused that at present no
other co-complainant / victim is available.
It is submitted by the IO that he is trying to contact other
co-complainants / victims. Ld. Counsel for the applicant / submits that as and
when the other co-complainants / victims come forward, the matter will be
settled with them.

In view of the above, most of the victims / co-complainants have
been compensated and they have expressed their satisfaction regarding the
settlement with the applicant / accused.
Accordingly, the applicant / accused Mehboob Khan S/o Sh.
Mehboob Khan is allowed to be released on bail upon furnishing personal
bond in the sum of Rs.40,000/- with one surety in the like amount (this is the
amount of bond which the son and husband of the present complainant were
required to furnish) to the satisfaction of the Ld. MM concerned / Ld. Duty
MM concerned, further subject to the following conditions:-
(i) That the applicant / accused will not try / influence /
contact any witnesses;
(ii) That the applicant / accused will join investigation as and
when directed by the IO; and
(iii) That the applicant / accused will not try / influence the
investigation in any manner whatsoever.
Copy of this order be sent to the Jail Superintendent concerned.
Copy of this order be given dasti to the parties.
The observations made herein shall not tantamount to the
expression of opinion on the merits of this case.
