Fresh suit is received by way of random allocation. It be checked
and registered.
Present : Sh. Shubham Kumar, Advocate for plaintiff

Heard. File perused.
During the course of submissions, Ld. Counsel of
plaintiff, on instructions, states at Bar that the plaintiff does not
wish to pursue the present suit as against defendant nos. 2 to 8 and
therefore, they may be deleted from the array of defendants, while
praying for issuance of summons of the suit to the defendant no.1
company namely ITD Technologie And Marketing Pvt. Ltd.
Ld. Counsel of plaintiff has also submitted that he has
sent an e-mail in this regard to the designated e-mail id of this
Court. Printout thereof is placed on record.
Having considered the submissions made on behalf
of plaintiff and keeping in view overall facts and circumstances of
the case, the request of the plaintiff is allowed. Consequently, the
defendant nos. 2 to 8 are hereby deleted from the array of
defendants.
In view of above, Amended Memo of Parties be filed
within 2 weeks from date of this order.
Subject to all just exceptions, issue fresh summons of
the suit to the defendant no.1 by all permissible modes including e-
mode
i.e. e-mail as provided in master data of defendant company
on taking requisite steps, as also subject to filing of soft copy of

complete paper book in PDF format by the plaintiff, returnable for
next date. Steps be taken within 2 weeks.
Process be also given dasti, if so requested.
Affidavit of service be also placed on record.
The summons shall indicate that written statement
has to be filed by the defendant within 30 days (extendable upto
120 days with the leave of the court and that too subject to
appropriate terms) from the date of service of the process as per the
Proviso of Sub Rule 1 of Order 5 Rule 1 CPC as applicable to the
Commercial Courts Act.
