It appears from the perusal of report filed by IO that
present case has been registered on the complaint of ASI Vijender
Singh, wherein he has alleged that his duty as Beat Officer was
on India Gate beside deployment of other police staff as well as
security staff of private security agency. It is stated that certain
vendors were selling articles at non-vending zone, they were
restrained not to do so by the beat staff in a special drive,
however the vendors did not follow the lawful directions. On
03.01.2023 at about 04.00 p.m. when vehicle of NDMC was
filling the articles of vendors who were not complying with
guidelines/directions, in that process vendors started putting
construction material on the security guards and fought with
NDMC staff and security guards deputed there and security
officials received serious injuries.
Today ld. Addl. PP for the State has pointed out that
grievous injuries have been caused to certain security staff
deputed at the India Gate.
Ld. Counsels for accused persons submit that none of the
public servant has received any grievous injuries, moreover most
of the vendors have been selling articles in or around India Gate
strictly in accordance with law and rules and they were given
rather beating from NDMC staff.
Having considered the submissions and taking note of the
fact that accused persons are in judicial custody since 04.01.2023
and no more required in the investigation, bail applications are
allowed. Accused persons are admitted to bail upon furnishing
bail bond for a sum of Rs.20,000/- with one surety in the like
amount to the satisfaction of ld. MM/Duty MM/concerned court,
