In view of the office order dated 31.12.2021, all matters are
being taken up through VC because of yellow alert and covid spike.
Present: Sh. Ravindra Kumar, Ld. Additional PP for the State through
VC.
Sh Pramod Tyagi, Ld. counsel for applicant/accused Ballu
through VC.
IO SI Hemant in person.
Ld. counsel for accused submits that the accused is in JC since
07.01.2022 in this case and recovery has already been effected and if
previous cases are concerned, the cases against this accused are of 2011 and
not in recent case, therefore, accused be released on bail.
Ld. Addl. PP on the other hand has strongly opposed the
application on the ground that accused has criminal antecedents and there
is a recovery of total 150 quarters of illicit liquor from the possession of
accused, therefore, accused is not entitled to be released on bail.
Heard. Considering the fact that accused is in JC since
07.01.2022 and no more required for investigation, the accused/applicant
Ballu is admitted to bail on his furnishing personal bond in the sum of Rs.
50,000/ with one surety in the like amount to the satisfaction of concerned
Ld. MM/Link MM/Duty MM till the disposal of the case.
Application is disposed of accordingly.
Copy of the order be given dasti as well as sent to accused
Ballu in jail.
