Counsel for the Petitioner. Application is filed under Section VI Rule 17 CPC seeking amendment of plaint on the ground that inadvertently M/s Astha Packaging Solution has been included as the defendant No. 1 firm in the suit whereas, the GST Certificate of defendant No. 1 is already suspended and recently defendant No. 2 has settled the accounts with legal heirs of his deceased partner as a consequence to the same, the plaintiff wish to delete defendant No. 1 from the memo of parties and consequently, there will be only one defendant, i.e., defendant No. 2 Amod Rai, who has been sought to be made as defendant No. 1 in the amended plaint. Present suit is still at the initial stage. Summons to the defendant are yet to be issued. Therefore, in the interest of justice, the application is allowed and plaintiff is allowed to carry out necessary amendments in the suit. Amended plaint is already filed along with the application. Let, the same be taken on record. Accordingly, application stands disposed of. Re-notify on 16.04.2026. Issue fresh summons to the defendant through all permissible modes on taking necessary steps.
