Heard. Perused.
Pleadings were to be completed by the parties as per
orders dated 12.10.2021 and 10.03.2021.
Replication was to be filed by the plaintiff with
affidavit of admission and denial of documents of defendant
within 15 days of 12.05.2022.
Nothing of that sort was done.
On 08.07.2022, above said was mentioned in the
order and plaintiff was burdened with costs of Rs. 2,000/-.
On 26.07.2022, on behalf of plaintiff, replication
was filed but without application for condonation of delay and
also without affidavit of admission and denial of documents of
defendant.
Ld. Counsel for plaintiff seeks adjournment wanting
to move appropriate application for condonation of delay in filing
replication and for filing affidavit of admission and denial of
documents of defendants.
Plaintiff is burdened with costs of Rs. 2,000/- to be
paid to defendant/Counsel in two days and also to file the receipt
of said costs in said period.
Fixed 08.09.2022 for further proceedings.
