Ld. Counsel for plaintiff has filed reply to
application of defendant under Section 151 CPC. Copy given.
Heard. Perused.
Defendant was served by e-mail on 26.10.2021.
Parties were to file pleadings in terms of order dated
10.03.2021 and 12.10.2021.
On 04.02.2022, defendant through Counsel filed
written statement with application for condonation of delay.
On 02.03.2022, it was observed that no statement of
truth in requisite form of affidavit and no list of documents
compliant with Order XI CPC for commercial dispute of
specified value were filed by defendant to make the written
statement compliant of mandatory provisions applicable to
commercial dispute of a specified value.
Later on 18.04.2022, defendant through Counsel
filed application to take on record appropriate statement of truth
and list of documents.
Ld. Counsel for plaintiff in the course of
submissions submits he has no objection if the said application of
defendant is allowed subject to some costs.
Considering the delay caused by the defendant, in
the fact of the matter, subject to costs of Rs. 5,000/- the above

said application of defendant under Section 151 CPC is allowed
and the statement of truth and list of documents be so taken on
record after payment of said costs to plaintiff/Counsel within one
week hereof.
Pleadings be completed by parties as per orders
dated 12.10.2021 and 10.03.2021.
Fixed 07.07.2022 for further proceedings.
This order be uploaded on the website of the Delhi
District Courts.
