Joint application has been filed under Order XXII
Rule 3 r/w Section 151 CPC with Settlement Agreement for out
of Court compromise between the parties. Statements of AR of
plaintiff and defendant; Ld. Counsel for defendant and Ld.
Counsel for plaintiff have been recorded separately.
Defendant has given cheque of Rs.5,00,000/- to AR
of plaintiff. Parties have amicably settled the matter in terms of
Settlement Agreement dated 18/01/2023 Ex. C-1 and joint
application for settlement under Order XXII Rule 3 read with
Section 151 CPC Ex C-2 which is supported by affidavits of
defendant Ex. C-3 and affidavit of AR of plaintiff Ex. C-4.
AR of plaintiff also stated in his statement that
nothing remains to be adjudicated now in this commercial suit.
As prayed, suit of plaintiff is decreed as
compromised in terms of Ex. C-1.
Parties shall abide by terms of Ex. C-1.
Reader to prepare decree sheet.
Ex. C-1 shall form part of decree.
