Matter taken up through Video Conferencing from the residence.
Present: Sh. S.K. Kain, Additional PP for the State (through V/C).
Sh. Shakir Shabbir, Advocate for accused Shanu & Tasleem (through
V/C).
Sh. Syed Amir Ali, Advocate for accused Fardeen (through V/C).
As per the report of the IO, FSL result is yet to be received and
therefore he seeks some more time to file the same.
Let, the same be filed within four weeks from to day. IO is also directed
to appear personally at the FSL and ensure that the FSL result be filed positively on
or before the next date of hearing.
In the meantime, a request letter be also issued to the Director, FSL to
expedite the result at the earliest.
Be put up for consideration on 09.02.2021.
An application filed on behalf of applicant/accused Balkishan for
release of Jamatalashi. IO is directed to file a detailed status report on or before the
next date of hearing.
At request, the application be put up for consideration on 13.01.2021.
An application has also been filed under Section 439 Cr. PC on behalf

of applicant/accused Shanu for grant of interim bail on the ground that his sister
namely Ruksar Bano expired while giving birth to a child on the evening of
10.01.2021. Relevant medical documents are placed on record.
Verification report also filed by the IO, which is taken on record,
whereby, the occurrence of unfortunate incident/mishappening has been confirmed.
Hence, considering the totality of the facts and circumstances and on
the note of humanitarian grounds, the application is allowed and the
applicant/accused Shanu is admitted to interim bail for a period of five days on his
furnishing a personal bond in the sum of Rs. 50,000/ with one local surety of the like
amount subject to the following conditions:
i) that the applicant shall not try to hamper the investigation or tamper with the
evidence;
ii) that applicant shall not directly or indirectly, make any inducement, threat or promise
to the complainant or any person / witness of the prosecution;.
iii) that the applicant shall join the investigation as and when required or so intimated by
the IO through notice ;
iv) that he shall furnish his mobile phone number to the police/IO/SHO against
acknowledgement which shall be kept operational at all times, so that the police
could contact him during the bail period ;
v) that in case he changes his mobile number or residential address or work
place, he shall inform the IO/SHO forthwith;
vi) that applicant/accused shall surrender before the jail authorities after the
expiry of interim bail period:

The application accordingly disposed of as allowed.
Ecopy of the order be sent to all the parties concerned.
Ecopy of the order be also sent to the concerned Jail Superintendent
for information and compliance.
At this stage, bail bond furnished, which is accepted.
The original documents be retained during the interim bail period.
