In between, Written Statement on behalf of defendant has been filed on
27.04.2024 along with documents and vakalatnama. Copy supplied.
Ld. Counsel for the plaintiff submits that there is a delay of approx. 21
days in filing of the WS by the defendant and no condonation of delay application
has been filed. Ld. Counsel for the defendant submits that the delay be condoned on
his oral prayer.
Ld. Counsel for the plaintiff submits that he has no objection if the
delay is condoned subject to cost.
Accordingly, delay is condoned subject to cost of Rs.1000/ to be paid
by the defendant to the plaintiff on the next date of hearing.
Plaintiff is directed to file replication, if any by the next date of
hearing. Advance copy of the same be supplied to the defendant.
Parties are directed to remain physically present on the next date of
hearing for admission/denial of documents.
Put up on 29.07.2024 for completion of pleading, admission/denial of
documents and framing of issues.
