Present: Sh. Jitender Kumar Kranti, Ld. counsel for the plaintiff with
plaintiff.
Sh. S K Sharma, Ld. counsel for the defendant.
Ld. counel for the defendant submits that defendant is unwell and
could not appear today.
At request, let cost be paid within two weeks by the defendant to the
plaintiff.
Ld. counsels for both the parties submit that they do not want to
admit or deny any of the documents and respective counsels for all parties submit
that issues may be framed in the present suit since the pleadings are complete.
From the pleadings of the parties and the material on record, the
following issues are framed in the present suit:-
1. Whethre the suit of the plaintiff is not maintainable ? OPD
2. Whether the plaintiff is entitled to decree of possession as prayed for ?
OPP

3. Whether the plaintiff is entitled to decree of recovery of sum of Rs.
45000/- as prayed for ? OPP
4. Whether the plaintiff is entitled to decree of damages/mesne profits, if
any and to what amount ? OPP
5. Relief.
No other issue arises or is pressed for.
Put up for PE for 01.10.2024.
List of witnesses be filed within 15 days from today, with advance
copy to the opposite side. Advance copy of the evidence affidavits be supplied to
the opposite side atleast two weeks before the next date.
