Present: Sh. Mahesh Chand, Ld. Proxy counsel for the plaintiff with
plaintiff
None for the defendant.
A proxy counsel with the name Mohd Rehman has appeared
through VC on behalf of the defendant, however, he is not in the attire
prescribed for a practicing advocate. Accordingly, his presence is not being
recorded.
Parties are hereby directed to maintain decorum of the court.
Matter has been received back from mediation centre as unsettled.
It is submitted by Ld. Counsel for the plaintiff that despite
directions of this court, vide order dated 27.01.2024, the defendant has failed
to supply copy of WS.
Heard.
The defendant is hereby directed to supply copy of WS within a
week from today to the plaintiff against acknowledgment. The defendant is
also hereby burdened with a cost of Rs 1,000/- for non compliance of the
order dated 27.01.2024 and thereby causing wastage of time today.
If, the WS is not supplied as per the above said directions, the
defence of the defendant shall be struck off on the next date of hearing. Let
reply to the application of the plaintiff under Order 39 Rule 1 and 2 CPC be
also filed by the next date of hearing with advance copy to the opposite side.
Let the replication, if any, be filed by the next date of hearing with

Put up for completion of pleadings and arguments on the
application under Order 39 Rule 1 and 2 CPC on 16.05.2024.
