Court notice issued to the Ld. Counsel for the
plaintiff has been received back served.
Court notice issued to the plaintiff has also been
received back served through one Sh. Ashish Kumar who
claimed to be a family member of the plaintiff.
Despite the same, none has appeared on behalf of
the plaintiff despite repeated calls. In view of the same, it appears
that plaintiff is not interested in pursuing his case. Accordingly,
the suit is dismissed for non-appearance.
Ahlmad is directed to take a print out of the plaint
and the documents e-filed by the plaintiff and tag it with the file
to ensure that the record is complete. This is necessary because,
as stated in the previous ordersheet, the physical copy of the suit
bearing CS No. 1007/24 was inadvertently filed in the present
case.
File be consigned to Record Room after necessary
compliance.

Present: None.
Upon perusal of the file, it is observed that no one
has been appearing on behalf of the plaintiff since the last two
dates of hearing. The present suit was instituted way back on
03.01.2025 and till date even summons have not been issued to
the defendant due to the laxity of the plaintiff. It is further
observed that two cases with the same parties were filed on
24.12.2024 (i.e. Civil Suit bearing No. 1004/24 and 1007/24).
Upon checking, it is observed that the suit e-filed and the hard
copy of the suit filed by the plaintiff do not match. It appears that
inadvertently, the plaintiff filed the physical copy of the suit
bearing CS No. 1007/24 instead of the suit bearing CS No.
1004/24. In such circumstances, this court deems it fit to issue
court notice to the plaintiff to seek clarifications.
Accordingly, issue court notice to the plaintiff and
ld. Counsel for the plaintiff, returnable for NDOH.
Be put up for further proceedings on 17.09.2025.
