Fresh suit received by way of assignment, it be checked and
registered as per rules.
Present: Sh. Puran Sharma, Ld. Counsel for the plaintiff.
This is a suit filed for permanent and mandatory
injunction with an application u/O XXXIX Rule 1 & 2 read with
section 151 CPC alongwith application u/s 53 B of DDA Act r/w
Section 80 (2) CPC.
Case file perused. Submissions heard.
In view of the averments made in the application
and considering the nature of the reliefs sought, this court is
satisfied that urgent relief is prayer for, which cannot brook
delay. Accordingly, the requirement of issuance of notices under
the necessary provisions of DDA Act and DMC Act is dispensed
with for the purpose of the present proceedings. Accordingly, the
application under Section 53 B of DDA Act stands disposed of.
Let summons be issued to all defendants alongwith
notice of the aforementioned application on filing of PF / RC /
through all prescribed modes returnable for NDOH.
Be put up for further proceedings on 04.12.2025.
