WS alongwith reply to application under Order 39
Rule 1 and 2 CPC and application for condonation of delay has
been filed on behalf of the defendants. Copy supplied.
Arguments have been heard on the application for
condonation of delay. Record has been perused.
There is a delay of approximately 30 days in filing
the WS. In view of the reasons mentioned in the application and
in the interest of justice, the delay stands condoned subject to a
cost of Rs.500/- to be paid to the plaintiff. The WS is,
accordingly, taken on record.
Also, applications under Order 7 Rule 11 CPC and
Order 26 Rule 9 CPC have been filed on behalf of the
defendants. Taken on record. Copy supplied.
The plaintiff has filed replication to the WS and the
reply to application under Order 39 Rule 1 and 2 CPC as well as
replies to applications under Order 7 Rule 11 CPC and under
Order 26 Rule 9 CPC. Taken on record. Copy supplied.
