Present:- Mr. Sanjeev Kumar, Ld. Counsel for the plaintiff.
1. This is a summary suit under Order XXXVII CPC for
recovery of an amount of Rs. 2,83,370/- alongwith interest
and costs.
2. Ld. Counsel for the plaintiff submits that inadverently
the heading of the plaint mentions Order XXXVII CPC.
However, the present suit has been filed as an ordinary suit.
3. A separate statement of Ld. Counsel for plaintiff is
recorded to this effect.
4. At this stage, Ld. Counsel for plaintiff has filed an
application under Order VII Rule 14 CPC for placing on
record certain additional documents viz. Ledger account and
all the invoices alongwith e-way bills.
5. The suit is at a nascent stage and summons are yet to
be issued to the defendant. Accordingly, the application is
allowed and the documents are taken on record.
6. Upon filing of PF within two weeks, issue summons for
settlement of issues to defendant by all permissible modes.
7. Copy of plaint be annexed with summons as per Order
V Rule 2 CPC. Summons shall state that the written
statement be filed by the defendant within 30 days from the
date of receipt of summons.
8. List the matter on 25.02.2026.
