Counsel for plaintiff, no written statement is available on the file as well as on the E-portal. Since the statutory period for filing the WS has elapsed, therefore, the opportunity for filing the written statement afforded to defendant is closed. The defence of defendant is struck off. Defendant is proceeded ex-parte. However, pronouncement of judgment under Order VIII Rule 10 CPC is not mandatory upon the Court and it is considered prudent to proceed with the matter for recording ex-parte PE.
