Present: Mr. J.M. Mittal, Ld. Counsel for the DH.
Ms. Payal Buddhiraja, Ld. Counsel for the
objector alongwith objector.
1. Warrants of possession and warrants of attachment
received back unexecuted with the report that ‘the suit
property was found locked’.
2. An application under Section 151 CPC has been filed
by the DH for authorizing the bailiff to break open the lock
of the suit property.
3. Upon filing of PF within a week, warrants of
possession in respect of premises as shown in site plan be
issued. Bailiff is authorized to break open the locks and the
SHO concerned is directed to provide assistance to the
bailiff at the time of execution of delivery warrants, if found
necessary.
4. The DH shall appear before the Ld. ACJ, for
appointment of bailiff on 23.04.2026. The warrants of
possession shall be returnable on 13.05.2026 Concerned
SHO is directed to provide necessary police aid to the
bailiff.
5. DH is directed to ensure that there is no stay against
the order sought to be executed and DH shall file an
affidavit to this effect at the time of filing of PF.
