Summons u/o XXXVII CPC qua defendant received
back served on 21.11.2024.
Ld. Counsel for defendant has filed the appearance
u/o XXXVII Rule 3 (1) CPC.
Ld. Counsel for defendant has submitted that the
appearance could not be filed in time due to medical condition of
the defendant. He has further submitted that the complete set of
paper book was also not supplied to him. He has further submitted
that the delay in filing the appearance be condoned u/o XXXVII
Rule 3 (7) CPC.
Medical documents have also been filed on record.
Order XXXVII Rule 3 (7) CPC specifies that for the
sufficient cause shown by the defendant the court may excuse the
delay in filing the appearance.
Considering the submissions and the medical record,
the delay in filing the appearance stands condoned.
Plaintiff has served the summons for judgment in
form no. 4A in appendix B to the defendant today against
receiving/acknowledgment.
Defendant is at liberty to file leave to defend with
