WS alongwith reply to application u/o XXXIX Rule 1 & 2
CPC alongwith an application seeking condonation of delay in filing the
WS has been filed on behalf of all the defendants. Copy has been
supplied to other side in advance.
The application u/o VIII Rule 1 CPC seeking condonation of
delay in filing the WS has been taken up for disposal.
Ld. Counsel for plaintiff has submitted that he has no
objection if the same is allowed subject to cost.
In view of his submissions, the delay in filing the WS stands
condoned subject to a cost of Rs. 1000/- to be paid to plaintiff. The WS is
taken on record. Application is accordingly disposed off. Cost not paid.
Defendant undertakes to pay the cost on the NDOH.
Plaintiff has filed the replication. Copy has been supplied
today to defendants.
Ld. Counsel for plaintiff has submitted that he will a fresh
application for interim injunction u/o XXXIX Rule 1 & 2 CPC.
Copy be supplied in advance to other side.
Be listed for arguments on the application u/o XXXIX Rule 1
& 2 CPC on 03.09.2024.
