Rana.
On perusal of the case file, it is observed that
warrants of attachment issued previously against the JD were
returned back with the report ‘premises found locked’. It appears
that the JD is intentionally trying to avoid execution of warrants.
In view of the above, let fresh warrants of
attachment of movable properties of the JD be issued on filing of
PF returnable for NDOH.
In case of refusal or the suit property being found
locked, Bailiff to break open the locks for execution of warrants.
Further, in view of notification no. 99/Rules/DHC dated
15.03.2010, the SHO concerned is directed to provide necessary
police aid, if required, to the Process Server upon application
being made in this regard.
DH is directed to appear before the office of Ld.
ACJ for appointment of Bailiff on 21.05.2025 at 02:00 PM.
Application filed seeking arrest of the JD by the Ld.
Counsel is for the time being taken on record. Appropriate orders
on the same shall be passed after perusal of compliance report
with regards the orders passed today.
Re-list before this Court on 22.07.2025.
