Fresh suit received by way of assignment, it be checked and
registered as per rules.
Present: Sh. Arvind Kumar, Ld. Counsel for the plaintiff.
Case file perused. Submissions heard.
It is observed that the address of defendant no. 5 i.e.
Ms. Sudha has been mentioned as the same as that of the
plaintiff. Ld. Counsel for the plaintiff submits that the said
address has been taken from the LIC Form filled by the deceased
husband of the plaintiff in 2019 as he has no details of defendant
no. 5.
In such circumstances, no useful purpose would be
served by summoning defendant no. 5 at this stage. Accordingly,
issuance of defendant no. 5 is deferred till the appearance of the
remaining defendants, who my apprise this Court of any details
available with respect to the said defendant.
Let summons be issued to only defendant no. 1 to 4,
on filing of PF / RC / through all prescribed modes, returnable
for NDOH.
Be put up for further proceedings on 28.11.2026.
