Present: Sh. Mohd. Imran, Ld Proxy counsel for the
plaintiff.
Sh. Rambir Chauhan, Ld. Counsel for the
defendant alongwith defendant in person.
WS alongwith reply to the application u/o 39 Rule
1 & 2 CPC and Vakalatnama have already been filed on behalf of the
defendant. The same are taken on record. Copy supplied to the Ld.
Proxy counsel for the plaintiff in the court today.
Ld. Counsel for the defendant states that the
defendant is the owner of the suit property. He further undertakes that
the defendant will not dispossess the plaintiff from the suit property
without due process of law. He further states that the mandatory
injunction sought on behalf of the plaintiff is not maintainable as
mandatory injunction cannot be granted against the true owner of the
suit property. He further states that the plaintiff has wrongly
mentioned the dimensions of the suit property as the suit property is
only 86 sq yds not 173 sq yds as averred by the plaintiffs in their
pleadings.
On this, Ld. Proxy counsel for the plaintiff states
that the main counsel is not available today.
Plaintiffs/main counsel for the plaintiffs are
directed to remain in person on NDOH.
Now to come up for 30.11.2023.
