Ld. Counsel for the plaintiff seeks an exemption
from the requirement of issuing statutory notice to MCD on the
ground that the relief sought is urgent.
In view of the averments made and considering the
nature of the reliefs sought, this court is satisfied that urgent
relief is prayer for, which cannot brook delay. Accordingly, the
requirement of issuance of prior notice is dispensed with for the
purpose of the present proceedings.
Let summons be issued to the defendant(s), on filing
of PF / RC / through all prescribed modes, returnable for NDOH.
Be put up for further proceedings on 28.10.2026.
