2. Reply has also been filed by defendant no. 3 to the
application of plaintiff under Order XXXIX Rule 1 & 2 CPC.

3. WS along with an application under Order I Rule 10
CPC filed by defendant no. 4. Copy supplied to other side.
4. Ld. Counsel for defendant no. 2 and 3 submits that he
has received the summons on 06.02.2026. He submits that
the complete copy of plaint has not been received.
5. Plaintiff is directed to supply the complete copy of
plaint on the WhatsApp number of counsel for defendant
no. 2.
6. Written statement (if any) be filed with an advance
copy to other side.

7. The application filed by defendant no. 4 under Order I
Rule 10 CPC seeking deletion of its name from the array of
parties has been taken up for consideration and disposal.
8. Ld. Counsel for the plaintiff submits that he has no
objection if the application is allowed and defendant no. 4
is deleted from the array of parties.
9. In view of the submissions, the application is allowed
and defendant no. 4 is deleted from the array of parties.
The application is accordingly disposed of.
10. Plaintiff is directed to file amended memo of parties.
11. List the matter for further proceedings on 27.03.2026.
