I have perused the judicial record.
In the present case, a suit under Order XXXVII CPC was filed on
behalf of the plaintiff for recovery of a sum of Rs. One lakh against the
defendant. The summons in prescribed proforma was issued to the defendant in
compliance of order dated 05.10.2024.
As defendant has already been served with the summons on
17.10.2024 and till date, no appearance has been filed on behalf of the
defendant in the court. The allegations in the plaint are deemed to be admitted
as per provisions of Order XXXVII Rule 2, Sub-Rule 3 CPC and plaintiff is
entitled to a decree of Rs. One lakh along with interest @ 6% per from the date
of decree till the date of actual realization. A decree be prepared accordingly.
File be consigned to record room after due compliance as per
rules.
