Present : Sh. Arvind Bhardwaj and Sh. Aakarsh Bhardwaj, Ld. Counsels
for the plaintiff alongwith plaintiff.
None for the defendant.
Present suit has been filed on behalf of the plaintiff for recovery
of Rs. 3,00,000/- against the defendant under Order 37 CPC.
Submissions heard on the maintainability of the present suit.
Present suit has been filed within the period of limitation as well
as jurisdiction of this court.
Issue summons to the defendant at the given addresses in the
prescribed format under Order 37 CPC on filing of PF/RC /Speed post
alongwith copy of plaint and documents within 7 days from today, to be
served through Ld. District Judge, Buland Shehar, UP and Gautam Budh
Nagar, UP returnable for the NDOH.
Counsel for the plaintiff is also directed to file on record
verified whatsapp number of the defendant by way of an affidavit within 7
days from today.
Plaintiff is also given liberty to serve the summons upon the
defendant through whatsapp at the given mobile number along with copy of
the plaint and documents and file his affidavit of service along with coloured
screenshot on the NDOH.
Further, at the request of the Counsel for the plaintiff, summons
be also issued by way of Dasti to the plaintiff to be served upon the

defendant, as per rules and the plaintiff is directed to file his report regarding
Dasti summons on the NDOH.
Now, put up for report on summons / further proceedings on
16.12.2024.
