Present : Sh. Dinesh Kumar, Ld. Counsel for decree holder.
An application u/s 39 CPC for transfer of decree for
execution to another Court is made by the DH. The application is
accompanied by the requisite affidavit.
The applicant avers in the application that the JD does not
have any property within the territorial jurisdiction of this Court but he
personally works for gain within the local limits of West District, Delhi
as he lives at F-80, Bali Nagar, Ramesh Nagar, Delhi-110015.
Considering the application as well as the submissions
made, the decree is required to be sent for execution to competent Court
having territorial jurisdiction over West District, Delhi.
Let the transfer certificate be issued as per rules and the
decree alongwith the certificate be sent to Ld. Principal District &
Sessions Judge, West Delhi through proper channel.
Remaining file be consigned to Record Room.
