An application under Order 8 Rule 1 CPC r/w Section
151 CPC for condonation of delay has been filed. Taken on record.

Arguments heard on the said application. Record
perused.
There is an approximate delay of 80 days in filing the
WS. It is submitted by the ld. Counsel for the defendant that the
delay occurred as the defendant had to travel to Varanasi to attend
to his ailing mother who was hospitalised due to chronic age related
ailments. It is observed that the application is not supported by any
documentary evidence relating to the ill health of the mother of the
defendant or the flight / train tickets of the defendant to Varanasi.
Despite the same, in the interest of justice and giving the benefit of
the doubt to the defendant, the application stands allowed and the
WS is taken on record. However, a cost of Rs.2,000/- is imposed
upon the defendant to be paid to the plaintiff to compensate for the
delay caused. Cost paid.
The plaintiff is directed to file replication, if any, with
advance copy to the opposite party before the NDOH.
Be put up for completion of pleadings, admission-
denial/ framing of issues on 18.07.2026.
