Ld. Counsel for defendant has submitted that the
plaintiff be directed to supply the legible copy of plaint and the
documents to him.
Ld. Counsel for plaintiff has submitted that he will
supply the soft copy of plaint and documents on the email ID of
the Ld. Counsel for defendant.
Ld. Counsel for defendant has shared his email ID
with Ld. Counsel for plaintiff.

Ld. Counsel for plaintiff has pressed on his
application u/o XXXIX Rule 1 & 2 CPC. He has submitted that by
way of this application he is seeking a temporary injunction

restraining the defendants from creating any third party interest in
suit property i.e. one room, one kitchen on ground floor in property
no. 10/7, Geeta Colony, Gandhi Nagar, Delhi-31. He has
submitted that the plaintiff is the owner of the suit property by way
of title documents in the form of GPA, Agreement to Sell, Will and
Affidavit executed by his father in his favour, in whose favour the
documents were executed by his grandfather and one uncle Avtar
Singh. He contended that it is necessary that defendants be
restrained from creating any third party interest during the
pendency of the suit.
Ld. Counsel for defendant has submitted that he has
no objection if the present application is allowed.
Separate statement of defendant is recorded to that
effect.
In view of his statement, the application u/o XXXIX
Rule 1 & 2 CPC stands allowed and the defendant is restrained
from creating any third party interest in the suit property during the
pendency of the suit. The application stands disposed of.
At joint request of the parties, the matter is referred to
Mediation Centre, KKD Courts, Delhi. The parties shall appear
before the Mediation Centre, on 08.01.2025 at 12:30 p.m. The
case shall be taken up in this Court for settlement (if any)/further
proceedings, on 19.02.2025.
