Present : Ld. Counsel for the plaintiff (through VC).
Plaintiff in person.
None for the defendant.
Today, counsel for the plaintiff has filed copy of the application
moved before the Hon’ble High Court of Delhi seeking withdrawal of the
writ petition earlier filed by the plaintiff before the Hon’ble High Court of
Delhi.
Submissions heard on the maintainability of the present suit.
Ld. Counsel for the plaintiff has submitted that he has no
objection if prayer clause (b) stands deleted and the case is proceeded only
qua relief (a) of the plaint. Said request is allowed and prayer clause (b)
stands deleted.
Further, defendant no. 2 does not seem to be necessary party for
the adjudication of the present case.
Accordingly, the name of the defendant no. 2 stands deleted
from the array of parties.
Counsel for plaintiff is directed to file amended memo of parties
within 7 days from today.
Plaintiff is directed to file an affidavit mentioning that no
similar matter is pending before any Higher Court and there are no direction

passed by any Higher court regarding the present suit positively within 7
days from today.
Thereafter, issue fresh summons to the defendant at the given
addresses on filing of PF, RC, Speed Post along with copy of plaint and
documents within 7 days from today, returnable for the NDOH.
Now, put up for report on summons / further proceedings on
23.11.2024.
