Counsels for the defendant alongwith father of
the defendant.
1. Replication has been filed by the plaintiff.
2. Ld. Counsel for the plaintiff submits that he will supply
the copy of replication to the defendant during the course of
the day.
3. Ld. Counsel for the defendant contends that the suit is
barred by limitation as, accordingly to the plaint, the cause of
action first arose six months after the last alleged loan
payment made on 29.02.2020.
4. In response, Ld. Counsel for the plaintiff submits that
although paragraph 13 of the plaint states that the defendant
had promised to repay the loan within six months, paragraph
6 reflects that certain payments were made by the defendant
within the limitation period. It is argued that such payments
amount to an acknowledgment of liability, thereby extending
the period of limitation under Section 18 of the Limitation Act,
1963.
5. At this stage, Ld. Counsels for the parties submit that
they will file certain judgments on record on the NDOH.
6. List the matter for arguments on the application under
Order VII Rule 11 CPC and consideration on the point of
limitation on 08.07.2026.
