Ms. Sudha Rani, Ld. Proxy Counsel for the
defendant alongwith defendant.
1. WS alongwith an application under Order VII Rule 11
CPC has been filed by the defendant. Copy supplied to the
other side.
2. Ld. Counsel for the plaintiff submits that there is a
delay of 44 days in filing the written statement by the
defendant. He submits that delay be condoned subject to
costs
3. Ld. Counsel for the defendant submits that the delay is
inadveretent and non deliberate.
4. In view of the submissions of the counsel for the
plaintiff, the delay in filing the WS stands condoned subject
to a cost of Rs. 1000/- to be paid to plaintiff. Cost paid. WS
is taken on record.
5. Ld. Counsel for the plaintiff seeks time for filing
replication.
6. Replication be filed with an advance copy to other
side.
7. Plaintiff is also at liberty to file reply to the application
of the defendant under Order VII Rule 11 CPC with an
advance copy to other side.
