Ld. Proxy counsel for the defendant submits that he has no
intimation about the defendant and seeks an adjournment in this regard.
Application filed under Order VIII Rule 1 CPC is taken on
record. Reply filed by the plaintiff to the said application is also taken
on record. Same be supplied on appearance of the defendant.
As adjournment is sought with respect to addressing
submissions on the application under Order VIII Rule 1 CPC and no
effective proceedings are being conducted today, cost of Rs. 3,000/- is
imposed upon the defendant to be paid to the plaintiff on NDOH.
It is made clear that the application shall be decided on
NDOH irrespective of appearance on behalf of the defendant.
