Present: Sh. Chandra Shekhar, Ld counsel for the DH.
Warrants of attachment issued upon the JD received back
unexecuted with the report that the DH was not available.
It is submitted by Ld counsel for the DH that concerned shop of
the JD has been sold by the JD and there is some error in the residence of the
JD in the memo of the parties.
DH is directed to file amended memo of parties by the next date of
hearing.
On filing of amended memo of parties, let warrants of attachment
of the movables properties of the JD be issued on filing of PF and list of
movables properties. DH is directed to ensure that there is no stay against the
order sought to be executed, and DH shall file his affidavit to this effect at the
time of filing of PF. Ld. Counsel for the DH is at liberty to seek police aid for
the execution of the warrants. The concerned SHO is directed to provide
police aid to the DH, if required. Bailiff can take assistance of local police if
the need arises, with direction to break open the locks in case the premises is
found locked. Endorsement in this regard be also made on the process.
DH is directed to appear before this court for appointment of
bailiff on 09.03.2026.
Put up the file alongwith report of the bailiff on 17.04.2026.
