Fresh suit received by way of assignment. It be checked and
registered as per rules.
Present: Sh. Ankit Singh Chauhan, Ld. Counsel for plaintiff.
This is a suit for recovery of amount of Rs.1,09,450/-
along with future and pendentelite interest @ 18% per annum.
Ld. Counsel has submitted that the plaintiff was
supplying the material of vanaspati and refined oil to defendant on
credit basis and as on 25.11.2021, an outstanding of Rs.1,09,450/-
is pending for payment. He has submitted that the cause of action
has arisen within the jurisdiction of this court as the goods were
supplied from the office of plaintiff situated within the jurisdiction
of this court. He has further submitted that the suit is within
limitation.
Submissions heard. Record perused.
Upon filing of PF within seven days, issue summons
for settlement of issues to defendant by all permissible modes.
Copy of plaint be annexed with summons as per Order V Rule 2
CPC. Summons shall state that the written statement be filed by the
defendant within 30 days from the date of receipt of summons.
Be listed on 11.11.2024.
