Mr. Aman Bhardwaj, Ld. Counsel for the
defendant.
1. WS alongwith reply to the application under Order
XXXIX Rule 1 & 2 CPC alongwith an application under
Order VII Rule 11 CPC filed by the defendant. Copy
supplied to the other side.
2. The application under Order VII Rule 11 CPC has
been taken up for consideration and disposal.
3. After some arguments, Ld. Counsel for the defendant
submits that he seeks to withdraw the application.
Accordingly, the application stands disposed of as
withdrawn.
4. Replication (if any) be filed with an advance copy to
the other side.
5. The application under Order XXXIX Rule 1 & 2 CPC
has been taken up for consideration and disposal.
6. Mr. Bhushan, Ld. LAC for the plaintiff, submits that the
plaintiff is the owner of the suit property in which the
defendant is residing as a licensee. He submits that by way
of this application, the plaintiff is seeking an interim
injunction restraining the defendants from creating any
third party interest in the suit property.
7. Mr. Bhardwaj, Ld. Counsel fo the defendant, submits
that the property has devolved upon the defendant by way

of succession as her husband (plaintiff’s son) was the
owner of the suit property, having purchased the same way
back in the year 2003 from the plaintiff. In any event, he
submits that the defendant does not intend to create any
third party in the suit property during the pendency of the
suit.
8. In view of the submissions of the counsel for the
defendant and also for the reason that the property should
not exchange hands during the pendency of the suit, the
application is allowed and the defendant is restrained from
creating any third party interset in the suit propety viz. First
Floor, House No. 13A, Gali No. 15, Indra Park Extension,
Krishna Nagar, Delhi-31, during the pendency of the suit.
The application is accordingly disposed of.
9. List the matter for completion of pleadings/A/D of
documents/framing of issues on 11.05.2026.
