1. An application u/o XXII Rule 3 read with Section 151 of the
Code of Civil Procedure, 1908 (CPC) for impleading the LRs of
deceased DH has been filed by the LRs of DH. Alongwith the
application, a death certificate alongwith Special Power of Attorney
dated 09.09.2025, executed in favour of one of the LRs, Mr. Diwakar
Mishra, by other LRs, has been filed on record.
2. The application has been taken up for consideration and
disposal.
3. Ld. Counsel for the DH submits that the DH has expired on
21.08.2025. She submits that the LRs mentioned in paragraph 2 of the
application are the only LRs of deceased DH.
4. Ld. Counsel for the objectors submit that he has no objection if
the present application is allowed.
5. Accordingly, the application is allowed and the LRs of deceased
DH/ assignee of original DH are brought on record. The application is
accordingly disposed of.
6. Amended memo of parties is taken on record.
7. Nazir is directed to tag the same at the front of the file.
8. Ld. Counsel for the DH submits that the stay is still continued
and the NDOH before the Ld. Appellate Court is 31.10.2025.
9. List the matter on 20.11.2025.
