Present: Sh. K.S. Kashyap, Ld. Counsel for the DH.
JD in person.
The JD submits that he vacated the suit property on
11.05.2025 and attempted to deliver the key to the DH via speed
post. However, the DH refused to accept the keys and the
possession of the suit property.
Ld. Counsel for the DH concedes that the JD
approached the DH with the keys to the suit property, which were
refused by the DH. He submits that the DH’s preference was to
take possession of the suit property in the presence of the JD to
ensure that no disputes arise later.
Upon query, the JD has submitted that the suit
property is vacant and no articles of his are lying therein.
Separate statement of the JD has also been recorded
to this effect.
In view of the statement given by the JD, ld.
Counsel for the DH submits that he is willing to accept the keys
to the suit property. The keys have been handed over to him in
court today. Ld. Counsel for DH is directed to apprise this court
regarding satisfaction of the execution petition qua possession of
the suit property on the NDOH.
Be put up for further proceedings on 19.12.2025.
