The report from bailiff received stating that the JD
had refused to pay the decreed amount and further no movable
property which could be attached belonging to JD was found and
therefore, the warrants could not be executed.
At this stage, Ld. Counsel for DH files the copy of
Relinquishment Deed dated 22.03.2023 as per which the property
bearing no. 16/145 situated at DDA Resettlement Colony known
as Trilokpuri, Delhi-110091 was relinquished by the other legal
heirs of late Sh. Jagdish Chand in the name of Ms. Shanti Devi
(JD).
Let court notice be issued to Sub-Registrar VIII with
the direction to verify the authenticity of Relinquishment Deed
dated 22.03.2023, returnable on NDOH.
Let the copy of Relinquishment Deed be sent along
with the notice.
Put up for further proceedings on 27.10.2026.

Fresh Execution received by way of e-filing. It be checked and
registered.
Present: Mr. Arun Kumar, Ld. Counsel for the DH alongwith
the DH.
1. This is a fresh execution petition seeking enforcement of
ex-parte judgment and decree dated 06.03.2026.
2. No notice under Order XXI Rule 22 (1) CPC is required to
be issued as the application for execution has been moved within
two years from the date of the decree.
3. Upon filing of PF within a week, warrants of attachment be
issued qua the movable properties of JD for the NDOH. The DH
shall appear before the Ld. ACJ, for appointment of bailiff on
27.07.2026. The warrants of attachment shall be returnable on
31.08.2026. Concerned SHO is directed to provide necessary
police aid to the bailiff.
4. DH is directed to ensure that there is no stay against the
order sought to be executed and DH shall file an affidavit to this
effect at the time of filing of PF
