Wife of JD (through VC).
Wife of JD submits that the bailiff has not visited the
property which was directed to be hand over to the DH and she
further submitted that they shall be filing the review petition with
respect to judgment dated 27.04.2026 passed in connected Civ
Suit no. 970/2025.
However, it is being perused that the order of civil
suit no. 83/2026 and the warrants to bailiff to give possesion of
land was with respect to the same property i.e. house no. 23D,
Pocket-B, SFS Upper Floor, Mayur Vihar Phase 3, Delhi-110096.
As per the report of bailiff, the main gate of the suit
property was found to be locked and after ringing the bell, the
wife and son of JD came and refused to vacant the property.
At this stage, further the wife of the JD concedes to
the fact that no review petition has been filed till date.
Ld. Counsel has submitted that the permission be
granted for breaking open the locks. Let fresh warrant of
possession in respect of premises as shown in the site plan be
issued on filing of PF. Bailiff is authorized to break open the
locks and the SHO concerned is directed to provide assistance to
the bailiff at the time of execution of delivery warrants, if found
necessary.

DH is directed to appear before Ld. ACJ (East) for
appointment of bailiff on 25.08.2026 and put up for report before
this court on 13.10.2026.
DH is directed to ensure that there is no stay against
the order sought to be executed and DH shall file his affidavit to
this effect at the time of filing of PF.
